I HAD the honour in my despatch No. 580 of the 4th ultimo to transmit to you copy of the note which on your instructions I addressed to the French Minister for Foreign Affairs on the 30th November last respecting the dispute between the Chinese Engineering and Mining Company and the French authorities in China.

I inclose herein M. Pichon's reply to my representations. His Excellency states that he does not consider that the considerations advanced by the Company are of a kind to alter the conclusions already arrived at on the French side. The legal adviser of the Company recently presented himself at the Ministry for Foreign Affa rs and expressed the desire of finding a basis of agreement in the matter. The same reply was returned to him as had already been given directly or indirectly to the Company, namely, that the French Government were ready to come to an arrangement on the lines indicated in M. Pichon's note dated the 4th July last (inclosure in my despatch No. 336 of the same date).

M. Pichon adds that he considers that further negotiations should take place at Peking, as it is easier to appreciate on the spot the various interests concerned in the matter.

Paris, le 15 Janvier, 1908. PAR un office en date du 30 Novembre dernier, vous avez bien voulu me faire parvenir la réponse de la Compagnie "Chinese Engineering and Mining," à la note que j'ai eu l'honneur d'adresser à votre Ambassade, le 4 Juillet dernier, au sujet de la question des terrains de Tsing Ouang-tao.

Les arguments mis en avant par la Compagnie en réponse à la note précitée ne me paraissent y répondre que d'une manière incomplète qui laisse subsister, à mes yeux, les conclusions auxquelles je me suis arrêté.

L'avocat conseil de la Compagnie "Chinese Engineering" s'est présenté récemment à mon Département et a exprimé le désir de chercher un terrain d'entente; il a appuyé sa démarche sur les intérêts Français considérables engagés dans la Compagnie "Chinese Engineering and Mining."

Je n'ai pu que renouveler à M. Cattiez les assurances qui avaient été déjà directement ou indirectement données à la Compagnie, tant par mon Département que par les Représentants de la France à Pékin, à savoir, que nous étions disposés à un arrangement équitable sur les bases exposées dans la note du 4 Juillet dernier. La Légation de la République en Chine a été autorisée à négocier sur ces bases avec les représentants de la Compagnie "Chinese Engineering and Mining"; c'est à Pékin que les parties intéressées sont le mieux placées désormais pour négocier un accord, étant plus à même d'apprécier sur place lê détail des intérêts respectifs en présence.
